1. Overview & Acceptance of Terms
These Terms and Conditions ("Terms") govern all purchases, sales, and other transactions conducted with First National Bullion Partners, LLC ("First National Bullion," "we," "us," or "our"), whether through our website, telephone, email, or other approved channels (collectively, the "Services"). By accessing the Services or placing an order, you agree to be bound by these Terms and our Privacy Policy.
2. Eligibility
You must be at least eighteen (18) years of age and have the legal capacity to enter into a binding contract to transact with First National Bullion.
3. Orders, Pricing, and Payment
All prices and availability are subject to change without notice. Orders become binding only upon receipt of cleared payment within required timeframes. Order confirmation emails are automated and do not constitute First National Bullion's acceptance of your order. All orders remain subject to review prior to shipment. First National Bullion reserves the right to refuse or cancel any order, including but not limited to orders deemed questionable, suspicious, a significant risk, priced in error, affected by abrupt market movements, or not paid within required timeframes.
4. Market Loss, Cancellations, and Administrative Fees
Once an order is placed, pricing is locked. Orders may not be canceled once confirmed. Where permitted, orders may be offset at current market prices and are subject to market loss and a standard administrative fee of $50. Any market gains on canceled or offset orders belong solely to First National Bullion. Customer expressly authorizes First National Bullion to charge any payment method on file for market loss, administrative fees, or other amounts owed.
5. Refunds, Returns, and Exchanges
Refunds, returns, and exchanges are limited to five (5) business days from the date of delivery. Customers must notify First National Bullion Customer Service within this period to request a return or exchange and to receive a Return Merchandise Authorization (RMA) number. Returns received without an RMA number may be refused. Once an RMA is issued, items must be shipped back within five (5) business days using an insured, trackable carrier. Shipping and handling charges are non-refundable. Customer is responsible for the cost of return shipping and insurance, and bears the risk of loss during the return shipment. Returned items must reasonably conform to the original order and these Terms. All refunds, returns, and exchanges are subject to market loss policies and a $50 administrative fee. Any market gains associated with returns belong solely to First National Bullion. Refunds will be processed to the original payment method within 5-7 business days of receipt and inspection. First National Bullion reserves the right to reject any return or exchange that does not reasonably conform to these requirements.
The following products are not eligible for return or exchange: special or custom orders; items damaged by acid testing or other intrusive testing conducted by customer; items returned without original packaging or documentation; and items marked as final sale at the time of purchase.
6. Sell-To-Us Transactions
Prices communicated verbally or in response to a general inquiry are indicative only, are not binding on First National Bullion, and are subject to change without notice. A price is only locked upon written confirmation of a Sell-To-Us transaction by First National Bullion. Quotes for items sold to First National Bullion are subject to inspection and verification. Pricing is not final until inspection is completed and acceptance is confirmed. Once a Sell-To-Us price is confirmed by customer, customer agrees to ship the items to First National Bullion within five (5) business days of price confirmation using an insured, trackable carrier and to provide a tracking number within one (1) business day of confirmation. If customer fails to perform — including by failing to ship within the required timeframe, failing to provide tracking, or shipping items that do not conform to the quantity or quality represented — customer shall be responsible to First National Bullion for any market loss First National Bullion incurs as a result, plus the standard $50 administrative fee. Customer expressly authorizes First National Bullion to charge any payment method on file for such amounts.
Identity and tax disclosure. By initiating a Sell-To-Us transaction, customer agrees to provide: (a) a valid government-issued photo identification document as required by applicable state law — including for all transactions in California and for transactions of $100 or more in Arizona; (b) customer’s Social Security Number or Taxpayer Identification Number (“TIN”) for tax reporting purposes. First National Bullion is required by law to file IRS Form 1099-B for applicable transactions. Failure to provide a valid TIN may result in backup withholding at the applicable IRS rate on the proceeds of the transaction. Customer consents to First National Bullion retaining identity and tax documentation in accordance with applicable law and the First National Bullion Privacy Policy.
7. Product Verification and Authentication
All precious metals, coins, bars, rounds, jewelry, or other items submitted to First National Bullion are subject to inspection, verification, and authentication using industry-standard methods. Verification may include visual inspection, weight and dimensional analysis, electronic testing, density testing, destructive testing, or third-party assay.
If an item is determined, in First National Bullion's sole discretion, to be counterfeit, altered, plated, materially different from its description, or otherwise not authentic, First National Bullion may decline to complete the transaction. In such cases, First National Bullion has no obligation to purchase, repurchase, return, refund, or otherwise compensate the customer. No bailment or custodial relationship is created by submission of items for inspection. Customers expressly assume all risk associated with items submitted outside of First National Bullion's chain of custody. Where permitted by law, First National Bullion may retain, surrender, destroy, or otherwise dispose of non-genuine items without liability.
8. Shipping, Risk of Loss, and Delivery Issues
Shipments are insured while in transit. Insurance coverage applies only while the package is in transit and ceases upon carrier-confirmed delivery. Risk of loss passes to the customer upon carrier-confirmed delivery. Damaged or missing items must be reported to First National Bullion in writing within forty-eight (48) hours of carrier-recorded delivery. Lost packages must be reported within thirty (30) calendar days of the date of shipment. Claims not reported within these timeframes may be denied. Orders are final once shipped. If a customer refuses delivery, the shipment will be returned and the customer may elect to pay for re-shipment or accept market loss and a $50 cancellation fee.
First National Bullion's insurance does not apply, and First National Bullion has no responsibility for loss or damage, where: (a) customer authorized waiver of the signature requirement with the carrier, or directed the carrier to leave the package without a signature; (b) the package was signed for or accepted by any person other than the customer, including building managers, mailroom personnel, or neighbors; or (c) the package was delivered to the customer-provided address and subsequently lost or stolen from that location. Customer is solely responsible for providing accurate shipping information; First National Bullion is not responsible for loss or delay resulting from inaccurate or incomplete information provided by customer.
9. Taxes
Customers are responsible for all applicable sales, use, income, or other taxes arising from transactions. First National Bullion does not provide tax advice.
10. Fraud Prevention and Compliance
First National Bullion reserves the right to delay, cancel, or refuse transactions where fraud, compliance, or verification concerns are identified, to record communications as permitted by law, and to cooperate with law enforcement or regulatory authorities as required.
11. Intellectual Property and Website Use
All website content, pricing data, trademarks, logos, and proprietary materials are owned by First National Bullion or its licensors. Users may not copy, scrape, reverse engineer, interfere with, disrupt, or misuse the website or its content, including by introducing malware, attempting unauthorized access, or using the site for unlawful purposes. If you believe any content on this website infringes your copyright, please send a written notice pursuant to the Digital Millennium Copyright Act (DMCA) to our designated agent: Martin Sanchez, Compliance Officer, First National Bullion Partners, LLC, 4885 Convoy Street, San Diego, CA 92111; email: martin@firstnationalbullion.com. Your notice must include: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the allegedly infringing material and its location on the site; (c) your contact information; (d) a statement of good-faith belief that the use is not authorized by the copyright owner; (e) a statement under penalty of perjury that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner; and (f) your physical or electronic signature.
12. Termination and Suspension
First National Bullion reserves the right, at its sole discretion, to suspend or terminate access to the Services or cancel transactions for violation of these Terms, suspected fraud, compliance concerns, or any conduct deemed harmful to the business or other customers.
13. Force Majeure
First National Bullion shall not be liable for delays or failures in performance caused by events beyond its reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, government actions, market disruptions, power failures, carrier delays, or system outages.
14. Disclaimer of Warranties
All products, services, and information are provided on an "as-is," "where-is," and "with all faults" basis. First National Bullion disclaims all express, implied, and statutory warranties, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, completeness, availability, and non-infringement.
15. Limitation of Liability
To the fullest extent permitted by law, First National Bullion shall not be liable for any indirect, incidental, consequential, special, or punitive damages. Aggregate liability, if any, shall not exceed the greater of one hundred dollars ($100) or the total amount paid by the customer for the transaction giving rise to the claim.
16. Indemnification
Customer agrees to defend, indemnify, and hold harmless First National Bullion and its members, managers, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses including reasonable attorneys' fees arising out of or related to the customer's use of the Services, violation of these Terms, or violation of applicable law.
17. Arbitration and Class Action Waiver
All disputes arising out of or relating to these Terms or transactions shall be resolved through binding arbitration on an individual basis, administered by JAMS, and conducted in California. Class actions, collective actions, and jury trials are waived. Any claim must be brought within one (1) year of accrual.
18. Export Controls
Customer represents that it will comply with all applicable United States export control and sanctions laws and will not export or re-export any products in violation of such laws.
19. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law rules.
20. Entire Agreement
These Terms, together with the Return Policy, Shipping Policy, Market Loss Policy, Privacy Policy, and Cookie Policy posted on the First National Bullion website each incorporated by reference, constitute the entire agreement between you and First National Bullion. In the event of any conflict between these Terms and any incorporated policy, these Terms control.
21. No Investment Advice
Nothing on the First National Bullion website or in any communication from First National Bullion or its employees constitutes investment, legal, tax, or other professional advice. First National Bullion is not a registered investment advisor or fiduciary. Precious metals investments involve risk, including potential loss of principal. Customers should consult independent professionals before making any investment decision.
22. General Provisions
If any provision of these Terms is held to be unenforceable, the remaining provisions continue in full force. First National Bullion's failure to enforce any provision is not a waiver of that provision. These Terms, and any rights or obligations hereunder, may not be assigned by customer without First National Bullion's prior written consent; First National Bullion may assign these Terms freely in connection with a merger, acquisition, or sale of assets. The following provisions survive termination of these Terms: Sections 4, 6, 7, 14, 15, 16, 17, and 21. Section headings are for convenience only.
23. Modifications
First National Bullion may update these Terms at any time by posting the revised version on the website with a new effective date. Continued use of the Services after any update constitutes acceptance of the revised Terms.
